4. Purposes of the processing

We process your personal data in the course of the online booking of an experience, accommodation, offer or brochure order. For this purpose, we process all personal data provided by you. The data processing serves the execution of the contract. If you do not provide this data, a booking cannot be made. Furthermore, we process your personal data if they evaluate your booking experience.

5. Legal basis for the processing and provision of your data

In accordance with Art. 6 para. 1 lit. b) GDPR, we process your personal data for the purpose of fulfilling a contract to which you are a party or for the implementation of pre-contractual measures taken at your request.

If you have given us your consent to process personal data for specific purposes (e.g. receiving newsletters or evaluating the booking experience), the lawfulness of this processing is based on your consent (Art. 6 para. 1 lit. a) GDPR).

We process your personal data if this is necessary to fulfill legal obligations (Art. 6 para. 1 lit. c GDPR) or to defend against legal claims asserted against us. The legal basis for this is Art. 6 para. 1 lit. f GDPR.

6. Categories of personal data

As part of the booking process and any subsequent evaluation, we process all data transmitted to us by you. This is general data about you (name, address, contact details, etc.), as well as information about the payment method.

7. Recipients or categories of recipients of the personal data

To complete the payment process, you have the option of paying by SEPA, credit card or PayPal. If you select credit card, you will be forwarded to the payment service provider Datatrans AG and if you select PayPal, you will be forwarded to the service provider PayPal. The respective data protection provisions of the payment provider then apply. We pass on your personal data within our company to the departments that require this data to fulfill contractual and legal obligations or to fulfill their respective tasks (e.g. sales and marketing). On the basis of a balancing of interests to protect our legitimate interests, service providers and vicarious agents employed by us who support us in the execution of the contract may receive data for this purpose. These are service providers from the categories of IT services, logistics and printing services. In addition, data may be passed on to third parties for the assertion of legal claims and defense in legal disputes, as well as for the prevention and investigation of criminal offenses.

10. Duration of storage of personal data

Your personal data will be deleted as soon as it is no longer required for the stated purposes. If necessary, we process your personal data for the duration of our business relationship.

In addition, we are subject to various retention and verification obligations, which result from the legal framework, among other things. The retention and verification periods stipulated therein result from the German Commercial Code, the German Fiscal Code and the German Money Laundering Act for up to ten years.

Ultimately, the storage period is also determined by the statutory limitation periods, which, for example, according to Sections 195 et seq. of the German Civil Code (BGB), are generally three years, but may be longer in certain cases.

If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR).

If you have consented to the data processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).

Please address requests for information, the revocation of consents granted or the exercise of your rights as a data subject to the controller named under 2. If you make use of your above-mentioned rights, the controller will check whether the legal requirements for this are met.
